Iranian TV clarifies Rouhani's Israel 'wound' comment

DUBAI (Reuters) - Two days before his inauguration as Iran's new president, Hassan Rouhani said on Friday that Israeli occupation of Palestinian land had inflicted a "wound" on the Muslim world, according to a segment of his remarks broadcast on Iran's state-run Press TV.

An earlier report by Iran's student news agency ISNA had quoted Rouhani as saying: "The Zionist regime is a wound that has sat on the body of the Muslim world for years and needs to be removed."

That version echoed the fiercely anti-Israeli language of outgoing President Mahmoud Ahmadinejad, but was swiftly repudiated by Iranian state media, which said unidentified news agencies had distorted Rouhani's remarks.

Press TV then broadcast an excerpt from an exchange between Rouhani and journalists at a rally to mark Iran's annual Al Qods Day in support of the Palestinians.

"After all, in our region there's been a wound for years on the body of the Muslim world under the shadow of the occupation of the holy land of Palestine and the beloved al-Qods (Jerusalem)," Rouhani said in the segment.

Israeli Prime Minister Benjamin Netanyahu seized on ISNA's version of Rouhani's comments, saying they showed the reputedly moderate Iranian cleric was as hostile to Israel as Ahmadinejad, whose denial of the Holocaust and description of Israel as a "cancerous tumor" prompted international condemnation.

The United States and its allies suspect Iran of seeking a nuclear weapons capability. Tehran says its nuclear program is purely for peaceful purposes, but Israel regards it as a threat to its existence and refuses to rule out military action.

With a more pragmatic president in Iran, Western countries may see a better chance for diplomacy to lead to a deal to curb Tehran's uranium enrichment program and avoid any conflict.

"The true face of Rouhani has been revealed sooner than expected. Even if they hurry to deny his words - this is what the man thinks and this is the Iranian regime's plan of action," Netanyahu said in a statement.

Rouhani's words "must awaken the world from the illusion in which part of it is placed since the Iranian elections", he declared, saying Iran still aimed "to acquire nuclear weapons in order to threaten Israel, the Middle East and world peace".

"A nation that threatens to destroy the state of Israel must not be allowed to have weapons of mass destruction," he said.

Ahmadinejad addressed Israel on Qods Day in his last speech as president. "You planted wind in our region and you will reap the storm. I swear to God that a ferocious storm is coming and it will uproot the Zionist entity," Iran's state news agency IRNA quoted him as saying.

Bay Area transit workers vow to strike in 72 hours

OAKLAND, Calif. (AP) ? Two San Francisco Bay Area transit unions are set to go on strike and shut down one of the region's major train systems if they don't reach agreement on a new contract.

Bay Area Rapid Transit's two largest unions issued a 72-hour strike notice Thursday evening. That means train service that serves more than 400,000 commuters each weekday could be shut down during Monday morning's commute if a deal isn't reached over the weekend.

Despite the warning, labor talks were to continue until the contract expires at midnight Sunday.

The two sides resumed negotiations around noon Thursday but did not appear close to an agreement.

Antonette Bryant, president of the Amalgamated Transit Union Local 1555, one of two unions in talks with BART, said before the strike notice was issued that progress was made on peripheral issues, but the "meat and potatoes" issues of the contract, including salaries and benefits, had yet to be resolved.

BART, the nation's fifth-largest rail system, carries passengers from the farthest reaches of San Francisco's densely populated eastern suburbs across the bay, through the city, and to San Francisco International Airport.

The agency contractually cannot hire any replacement workers, but BART spokesman Jim Allison said it will secure about 95 charter buses to transport Bay Area commuters if there's a strike.

The unions went on strike last month, shutting down BART service for four days and snarling transit in the region. Commuters faced long lines for buses and ferries, and roadways were jammed, but a transit shutdown next week could be more disruptive because the first work stoppage occurred around the Fourth of July holiday.

The unions ? which represent nearly 2,400 train operators, station agents, mechanics, maintenance workers and professional staff ? agreed to call off the strike and extend their contracts until Aug. 4 while negotiations continued.

Key sticking points in the labor dispute include worker safety, pensions and health care costs, according to BART and union officials.

The transit agency has said union train operators and station agents average about $71,000 in base salary and $11,000 in overtime annually. The workers pay nothing toward their pensions.

BART says it needs to save money on benefits to help pay for system improvements.

Unions submitted their last financial proposal last month and were awaiting a counteroffer from BART, said Josie Mooney, chief negotiator for the local Service Employees International Union, the other union in talks with BART. Mooney said they offered to contribute to the pension, but she could not say how much because of a gag order issued by a mediator.

Jury: $37.5M to family of smoker who died of lung cancer

FORT LAUDERDALE, Fla. R.J. Reynolds says it will appeal a Florida jury's decision to award $37.5 million in damages to the family of a smoker who died of lung cancer in 1995.

Laura Grossman, of South Florida, died at age 38.

The verdict includes $22.5 million in punitive damages against R.J. Reynolds .

Attorneys for the Grossman family argued that as a teenager, Grossman was targeted by tobacco companies.

R.J. Reynolds' lawyers said Grossman knew the dangers of smoking because cigarettes had warning labels when she started.

The case is one of thousands filed in Florida after the state Supreme Court in 2006 tossed out a $145 billion class action verdict. That ruling also said smokers and their families needed only prove addiction and that smoking caused their illnesses or deaths.

Dan Hawkins fired as coach of Montreal Alouettes ? five games into CFL season

In February, Former Colorado Buffaloes coach Dan Hawkins landed on his feet in Canada, taking a job as coach of the Montreal Alouettes of the CFL. But that job came to a sudden end Thursday.

Alouettes owner Bob Wetenhall fired Hawkins from his post and appointed general manager Jim Popp the new coach, the team said.

?Jim is the person most responsible for the success we have had over all these years,? Wetenhall said in a statement.

?I feel confident that he is the best person to coach our team at this time and I am very appreciative of him being willing to make this additional contribution to our franchise. He has the respect of our players as well as mine.?

Wetenhall didn?t give a reason for Hawkins? dismissal.

Montreal is 2-3 in the East Division of the CFL, one game behind the division-leading Toronto Argonauts.

In his final game as Alouettes coach, Hawkins helped lead the team to a 32-27 victory over the Edmonton Eskimos in front of 23,021 fans in Montreal.

The Toronto Sun on Thursday reported that Montreal quarterback Anthony Calvillo has struggled under Hawkins:

Alouettes quarterback Anthony Calvillo has been frustrated at times, whether it has been showing his displeasure on the field during games or in interviews afterward.

Calvillo is fourth with 1,035 passing yards, but his 60.1% completion rate is below average in comparison to the CFL?s other regular starters. Calvillo has thrown for just five touchdowns and has been intercepted four times.

Hawkins was hired to replace Mark Trestman, who left to become head coach of the Chicago Bears. Trestman has yet to coach a game with his new team, while Hawkins is already out of a job.

NCAA- EA Sports Lawsuit: 9th Circuit Court Rules Against Game Company, Lawsuit Will Continue

On Wednesday, a three-person federal appeals panel by a vote of 2-1 overruled the argument from Electronic Arts that the 1st amendment protects them from the lawsuit brought on by former college athletes Ed O'Bannon and Sam Keller.

EA argued that the 1st amendment gave them free expression and artistic work when they use the likenesses of college athletes in video games. The two judges ruled that EA "does not qualify for First Amendment protection as a matter of law because it literally recreated (Sam) Keller in the very setting in which he has achieved renown." They looked at the fact that while Keller's name isn't in the game, his exact height, weight, skin tone, build, hair color, home state, throwing hand and year of eligibility is uses giving fans the impression that the player in the game in Sam Keller.

"Given that NCAA football realistically portrays college football players in the context of college football games, the district court was correct in concluding that EA cannot prevail," wrote Judge Jay S. Bybee in the decision.

The judge who voted for EA wrote in his dissenting opinion that "because the creative and transformative elements of Electronic Arts' NCAA Football video game series predominate over the commercial use of athletes' likenesses, the First Amendment protects EA from liability."

Nathan Siegel, who filed the brief for EA and other media companies called the decision by the three member panel "disappointing."

"This decision flies in the face of principles of creative expression that have been in place for decades," said Siegel.

"The court is doing one of two things. It's either creating a special rule of law for video games, even though the Supreme Court said a few years ago that video games have the same right of expression as other forms of media. Or, the court is articulating some principle that could be applied more broadly, which would open the door for more celebrities to assert their right [to publicity in media products].

The next step for EA is an appeal of Wednesday's ruling to the 9th Circuit Court with the Supreme Court as a possible destination. ?

EA used examples of movies which are not subject to judgments on using someone's name or likeness. In a 2009, Hall of Fame running back Jim Brown argued that a player similar to him when he played in the 1960's "represented a false endorsement" of the game he was featured in. In that case, it was determined that EA did not try to deceive users about Brown's involvement in the game.

On Monday, EA filed a brief for a possible dismissal from the case with U.S. District Judge Claudia Wilken. While Wednesday's ruling does not affect the filing on Monday, it does help cement the O'Bannon/Keller lawsuit as legitimate. EA must stay in the fight with the NCAA and Collegiate Licensing Company in what could turn out to be a lawsuit that could go on for years.

"Because we won against EA, we will be able to go against the NCAA for its looking the other way and increasing its royalty by using the likenesses of the students," said Rob Carey, the attorney for Keller and other former players who joined the lawsuit. "We look forward to showing a jury the hypocrisy of the NCAA along with the blatant misappropriation by Electronic Arts of the property of the student athletes."
